1. These terms
These terms are an agreement between you and Berthly, operated by Peter Bowers-Davis in the United Kingdom (“we”, “us”). By creating an account at berthly.app you accept them. Contact: hello@berthly.app.
2. What Berthly is
Berthly is a digital home for your vessel: a place to keep vessel records, documents, reminders, equipment, maintenance history, costs and trip logs, and to share them with crew you choose. Berthly is currently in an early-access phase and is provided free of charge; paid plans may be introduced later, and we will tell you clearly before anything becomes chargeable.
3. Your safety responsibilities — please read this one
Berthly is an organisational aid, not a safety authority. Checklists, reminders, maintenance schedules and briefing prompts are provided to help you stay organised. They are generic, may not cover your vessel or circumstances, and are no substitute for your own judgment, proper training, manufacturer guidance, or the maritime laws and safety requirements that apply to you. As skipper or owner, you remain solely responsible for the seaworthiness and safe operation of your vessel and the safety of those aboard.
Reminder emails can fail, be delayed, or be filtered as spam. Do not rely on Berthly as your only system for safety-critical dates such as insurance, certification or equipment servicing.
4. Your account
- Keep your sign-in method secure. Anything done through your account is your responsibility until you tell us it has been compromised.
- Give us a real email address — the service works by emailing you.
5. Your content
Everything you upload or record stays yours. You give us the limited licence needed to store, process, back up and display it — solely to run the service for you and the crew you invite. You are responsible for having the right to upload what you upload, and for the consent of people whose names or emails you record (crew, guests, invitees).
6. Acceptable use
Use Berthly lawfully and only for its purpose. Do not attempt to access other users’ data, probe or disrupt the service, or upload unlawful or malicious content. We may suspend or close accounts that break these terms.
7. Availability and changes
Berthly is provided “as is”. During early access, features may change, and we do not guarantee uninterrupted availability. We work to keep your data safe and backed up, but you should keep your own copies of critical documents — your originals remain your originals.
8. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for indirect or consequential losses, loss of data you have not kept originals of, or losses arising from missed or delayed reminders; and our total liability in connection with the service is limited to £100 or the amount you have paid us in the past 12 months, whichever is greater.
9. Ending things
You can delete your account at any time from the Account page, which permanently removes your data. We may suspend or end accounts that breach these terms, and will give notice where reasonable.
10. Changes to these terms
If we make material changes we will tell you by email or in the app before they take effect. Continuing to use Berthly after that means you accept the new terms.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — though if you live elsewhere in the UK you keep the protection of your local consumer law.
